The agreement between you and CD919 Performance when you purchase a custom calibration, file, or product.

⚠ Read carefullyTuning a vehicle changes how its engine, transmission, and drivetrain behave. The terms below outline what we provide, what we do not warrant, and the responsibilities you accept by ordering work from CD919 Performance. If anything here is unclear, reach out before ordering.
1. Acceptance of Terms
By purchasing tuning services, calibration files, or merchandise from CD919 Performance, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in full. If any portion of these terms is unacceptable to you, do not purchase or use our products and services.
2. Off-Road & Competition Use Only
All performance calibrations and related products provided by CD919 Performance are sold strictly for closed-course, off-road, motorsport, and competition use. They are not designed, intended, or warranted for use on public roads or highways. The customer is solely responsible for ensuring compliance with all applicable local, state, federal, and international emissions, noise, and traffic regulations.
3. Warranty Disclaimer
Modifying your vehicle's engine control software (ECU/DME) may void some or all of your manufacturer's warranty, including powertrain coverage. CD919 Performance is not responsible — directly or indirectly — for any warranty claims that are reduced, denied, or invalidated by your dealership or manufacturer as a result of installed calibrations or related modifications.
4. Assumption of Risk & Limitation of Liability
Performance tuning carries inherent mechanical and operational risk. To the fullest extent permitted by law, CD919 Performance shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to engine, transmission, drivetrain, turbocharger, fuel system, or electronic component failure, loss of use, lost profits, or personal injury — arising from the purchase, installation, or use of our calibrations or products. The customer assumes full responsibility for any such risk.
5. Customer Hardware Responsibility
Each calibration is built around the hardware, fueling, and modifications disclosed by the customer at the time of order. It is the customer's responsibility to verify that all supporting hardware (including but not limited to fueling, cooling, charge piping, intercooling, and turbochargers) is in good working condition and appropriate for the requested power level. Misrepresented or undisclosed modifications void the calibration's intended safety margins.
6. Datalogging & Revisions
Custom calibrations include reasonable revisions based on properly captured datalogs submitted by the customer. CD919 Performance reserves the right to limit revisions where mechanical issues, hardware faults, or improper logging procedures are identified. The customer is expected to follow datalogging instructions in good faith.
7. Refund & Return Policy
Due to the bespoke nature of custom calibration work, all tuning sales are final once an initial map has been delivered to the customer.
8. Intellectual Property
All calibration files, base maps, documentation, branding, and supporting materials remain the sole intellectual property of CD919 Performance. Resale, redistribution, reverse engineering, sharing, or transferring of calibration files to any third party is strictly prohibited and may result in service termination.
9. Vehicle Condition
The customer represents that the vehicle being tuned is in good mechanical health prior to calibration. CD919 Performance is not responsible for diagnosing or repairing pre-existing mechanical, electrical, or fueling defects. If a vehicle is found to be in unsafe condition, calibration work may be paused or refused without refund of work already performed.
10. Changes to These Terms
CD919 Performance reserves the right to update, modify, or replace any portion of these Terms of Service at any time and without prior notice. Continued use of our services after changes are posted constitutes acceptance of the revised terms. Customers are encouraged to review this page periodically.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the United States and the state in which CD919 Performance operates, without regard to conflict-of-law principles. Any dispute arising under these terms shall be resolved in the appropriate courts of that jurisdiction.
